In no event shall REI Leader and/or its suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of this website or with the delay or inability to use this website, or for any information, software, products, and services obtained through this website, or otherwise arising out of the use of this website, whether based on contract, tort, strict liability or otherwise, even if REI Leader or any of its suppliers has been advised of the possibility of damages. The company does not accept any responsibility for loss of any kind resulting from any failure of email services.
We will take all reasonable steps to ensure accurate and prompt routing of messages but we will not accept any liability for non-receipt or mis-quoting or any other failure of email.
Payment of Charges
Subscriber agrees to pay, using a valid credit card which REI Leader accepts, the charges incurred on Subscriber's account in order to access Fee-Based Services, applicable taxes, lead payment fees, and any other applicable fee. REI Leader reserves the right to increase fees, surcharges, and site subscription fees, or to institute new fees at any time, upon reasonable notice posted in advance on this Site. REI Leader will automatically charge Subscriber's account for any lead made available to the Subscriber. In the event REI Leader cannot charge Subscriber's account, REI Leader reserves the right to terminate Subscriber's access to the Fee-Based Services.
For purposes of identification and billing, Subscriber agrees to provide REI Leader with accurate, complete, and updated information required by the site subscription registration to the Fee-Based Services ("Registration Data"), including Subscriber's name, address, telephone number(s), and applicable payment data (e.g., credit card number, e-mail address, and expiration date). Subscriber may check, by accessing their self service account portal, to determine whether Subscriber's Registration Data is current and accurate, and, if not, to correct or update Subscriber's Registration Data. Failure to comply with this provision (including, without limitation, falsification of any Registration Data) may, at REI Leader's option, result in immediate suspension or termination of Subscriber's right to use the Fee-Based Services.
Credit Resolution
In the event that a lead is invalid and does not contain correct contact information, within 15 days of the lead information email being sent the User may request a lead replacement. Lead replacements are only applicable to paid leads. If a lead replacement request for a purchased lead is resolved in favor of a paying user REI Leader will issue a service credit to the user account for one motivated home seller lead. User account credits cannot be credited. User account credits cannot be refunded. Replacement leads can only be sent to active accounts.
In the event that you cancel the Investment Leads Program, REI Leader will not refund any fees already paid by you. Please refer to the Participation Guidelines for complete information on the lead replacement request and case resolution process.
Cancellation and Termination

You are solely responsible for properly cancelling your account. To request the cancellation of your account you need to send an email to customerservice@reileader.com. All email requests for cancelling your account must include the word "cancel" as part of the subject field and must clearly request the termination of your account. We will acknowledge your cancellation request by email or by telephone within one business day. If you don't receive an acknowledgement within one business day please call our customer service department to determine if your request was received.

As part of the cancellation process we may require you to complete and fax a signed copy of our cancellation form. You are responsible for returning the completed form so the account can be properly cancelled.

Cancellation requests are only processed during regular business hours during business days. We reserve the right to take up to 30 business days to officially cancel your account. Business days are Monday through Friday, 8 AM EST to 4 PM EST; excluding holidays.

You are responsible for the payment of any charges incurred by your account from the time that the cancellation request was made until the account is terminated.

In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system.

REI Leader, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other REI Leader service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all information in your Account. REI Leader reserves the right to refuse service to anyone for any reason at any time.

Indemnification
You agree to hold harmless and indemnify Agitantis LLC, and its subsidiaries, affiliates, officers, agents, investors and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, Agitantis LLC will provide you with written notice of such claim, suit or action.
Personal and non-Commercial use Limitation
This Web site is for your personal and non-commercial use. You may not modify copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this Web site. No Unlawful or Prohibited Use
As a condition of your use of this web site, you warrant to REI Leader that you will not use this web site for any purpose that is unlawful or prohibited by these terms, conditions, and notices.
If you knowingly input false information in a referral request, including but not limited to someone else's name, e-mail address, physical address or phone number or a random or made up name, address, e-mail or phone number you agree to fully indemnify and be liable to REI Leader and each REI Leader registered real estate agent or investor who accepts such referral requests, for the greater of: (1) a minimum amount of $15,000 to each of REI Leader and each of the affected real estate agents or investors and for each of the actual person(s) affected by any of the improper, incorrect or fraudulent information you enter (for example the actual owner of the e-mail address or phone number, etc.), per improper submission, plus any attorneys fees costs and expense relating thereto, if applicable, or (2) the actual damages, direct, punitive and consequential, and any regulatory or judicial fines or penalties that may arise from such intentional, misleading, harmful and fraudulent activity, plus reasonable legal fees, cost and expenses relating thereto, which ever is greater.
General
This agreement is governed by the laws of the State of Washington, USA. You hereby consent to the exclusive jurisdiction and venue of courts in King County, Washington, USA in all disputes arising out of or relating to the use of this Web site. Use of this Web site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and REI Leader as a result of this agreement or use of this Web site.
REI Leader's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of REI Leader's right to comply with law enforcement requests or requirements relating to your use of this Web site or information provided to or gathered by REI Leader with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this agreement shall continue in effect.
This agreement constitutes the entire agreement between the user and REI Leader with respect to this Web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and REI Leader with respect to this Web site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Any rights not expressly granted herein are reserved. REI Leader reserves the right to modify the Terms of Service and Program Participation Guidelines without notice.
